You agree that any product purchased from LittleSmartStore will be opened, set up and used strictly under direct adult supervision.

3.2 Age Appropriateness & Warnings

Customers are strictly responsible for reviewing and adhering to all minimum age recommendations, hazard warnings and instructional guidelines provided on product packaging or included documentation.

📦 Dropshipping & Third-Party Manufacturer Limitations

4.1 Retailer Status

LittleSmartStore is an e-commerce retailer and distributor; we are not the original manufacturer of the physical products sold on this site.

4.2 Product Safety Standards & Certificates

Products are sourced from third-party manufacturers who are responsible for product design, testing, manufacturing quality and compliance certifications, such as CPSC/CPSIA compliance certificates or ASTM standards.

• To the fullest extent permitted by law, LittleSmartStore disclaims all indirect liability for structural design defects, manufacturing errors or false compliance claims made by third-party suppliers.
• In the event of a product defect, quality failure or manufacturer recall, LittleSmartStore’s maximum liability to you will be governed by Section 10 (Limitation of Liability).

🏷️ Accuracy of Product & Pricing Information

5.1 Color & Visual Accuracy

We make every effort to display as accurately as possible the colors and images of our products. However, we cannot guarantee that your device’s display monitor will reflect the exact colors of the physical product.

5.2 Product Variations & Modifications

Minor aesthetic variations in packaging, component color or instructional layout may occur between manufacturing batches. We reserve the right to modify or discontinue any product at any time without notice.

5.3 Pricing Errors

Prices for our products are subject to change without notice. In the event a product is listed at an incorrect price due to a typographical or system error, we reserve the right to cancel or refuse any orders placed for that product.

🧾 Orders, Customs, Imports & Shipping

6.1 Order Finality & Accuracy

Please verify all shipping addresses and item selections prior to completing checkout. Once an order is processed, modifications or cancellations cannot be guaranteed.

6.2 Importer of Record (US & International Shipping)

For goods shipped directly from international fulfillment centers to your address:

• The customer is designated as the Importer of Record.
• You are solely responsible for ensuring the product can be lawfully imported into your jurisdiction and for paying any applicable local customs duties, sales taxes or import fees imposed by U.S. Customs and Border Protection or local authorities.

6.3 Delivery & Carrier Risk

Title and risk of loss for all products pass to you upon our delivery of the package to the shipping carrier. LittleSmartStore is not liable for packages lost, stolen or misdirected due to customer address entry errors.

🔄 Returns & Refunds

All returns, damages, missing parts claims and exchanges are strictly subject to our separate Refund Policy, which is incorporated into these Terms by reference.

🚫 Prohibited Uses

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content:

• For any unlawful purpose or to solicit others to perform unlawful acts;
• To violate any international, federal, state or local laws or regulations;
• To infringe upon or violate our intellectual property rights or those of others;
• To submit false, misleading or fraudulent information;

We reserve the right to terminate your use of the Service for violating any prohibited uses.

You agree to indemnify, defend and hold harmless LittleSmartStore, our parent entities, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors and employees from any claim, demand, liability, loss or expense—including reasonable attorneys’ fees—made by any third party due to or arising out of:

2. Your violation of any law or the rights of a third party;
3. Misuse, failure to supervise or improper handling/assembly of any product purchased from LittleSmartStore resulting in property damage or personal injury.

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability shall be limited to the maximum extent permitted by law, not to exceed the total purchase price paid by you for the product giving rise to the claim.

These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of the Emirate of Ajman and the federal laws of the United Arab Emirates, without giving effect to conflicts of law principles.

11.2 Binding Individual Arbitration – For United States Buyers

• Agreement to Arbitrate: Any dispute, claim or controversy arising out of or relating to these Terms, the breach thereof, or the purchase and use of any product from LittleSmartStore shall be settled through binding, individual arbitration rather than in court.
• Class Action Waiver: You and LittleSmartStore agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class, consolidated or representative proceeding.

These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of the Emirate of Ajman and the federal laws of the United Arab Emirates, without giving effect to conflicts of law principles.

11.2 Binding Individual Arbitration – For United States Buyers

• Agreement to Arbitrate: Any dispute, claim or controversy arising out of or relating to these Terms, the breach thereof, or the purchase and use of any product from LittleSmartStore shall be settled through binding, individual arbitration rather than in court.
• Class Action Waiver: YOU AND LITTLESMARTSTORE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED OR REPRESENTATIVE PROCEEDING.

📋 Severability & Entire Agreement

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms.

These Terms of Service and any policies posted by us on this site constitute the entire agreement and understanding between you and LittleSmartStore.
